5. Subscription and Payment Terms

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRESHNOX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT.

Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid to us in the twelve months preceding the claim.

You agree to indemnify and hold harmless Freshnox and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
